Advisory Issued Against Bathing at 66 Suffolk County Beaches Due to Heavy Rainfall

Tanner Park Beach Remains Closed

James L. Tomarken, MD, MSW, MPH, MBA, FRCPC, FACP, Commissioner of the Suffolk County Department of Health Services, said today that due to the heavy rainfall that occurred yesterday and the additional rain that is forecasted for today, the Suffolk County Department of Health Services has issued an advisory against bathing at 66 beaches, including beaches located along the northern shoreline of Great South Bay, in Sag Harbor, within and adjacent to various north shore embayments (Cold Spring Harbor, Huntington Harbor and Bay, Centerport Harbor, Northport Harbor and Bay, Port Jefferson Harbor, and Stony Brook Harbor), and those Long Island Sound beaches that are directly impacted by nearby storm water discharges (list attached).

The advisory is based on the potential that bacterial numbers in excess of New York State standards, resulting from the heavy rain, will impact these areas.

The beaches covered by the advisory are located in areas that are heavily influenced by stormwater runoff from the surrounding watersheds and/or adjacent tributaries, and, because of their location in an enclosed embayment, experience limited tidal flushing.

Beaches not directly influenced by stormwater runoff, including those located on the Atlantic Ocean, the Peconic Estuary, and most beaches on Long Island Sound, are not affected by this advisory.

The Department recommends that bathing and other water contact be suspended in affected areas until the waters have been flushed by two successive tidal cycles (at least a 24 hr. period) after the cessation of rainfall.  Unless sampling done by the Department finds elevated bacterial numbers persisting beyond the 24-hr period, this advisory will be rescinded as of 8 PM on Tuesday 8/24/010.

Dr. Tomarken also said today that Tanner Park Beach in Copiague is closed to bathing as results of recent samples are elevated in relation to standard criteria.

For the latest information on affected beaches, call the Bathing Beach HOTLINE at (631) 852-5822, contact the Department’s Office of Ecology at 852-5760 during normal business hours, or visit the website link below and in the Popular Links box, click on “Beach Advisories Map” (http://www.suffolkcountyny.gov/health).

Chris Cox To Appeal Judges Ruling

Judge Ignores Facts to Disenfranchise Conservative Voters, Cox Vows to Defend Conservatives’ Demand for a Fair Primary

SMITHTOWN, NY - Aug 20, 2010 In a continuing effort to ensure the rights of the hundreds of enrolled Conservatives who demanded that their Party hold a primary, Chris Cox, the real conservative Republican in the First Congressional District contest to unseat a liberal Democratic incumbent, reiterated his vow to protect their right to have a say in choosing a true conservative to be their standard-bearer in November.

Cox promised to appeal the outrageous ruling by a judge, who despite clear bias, refused to recuse himself after repeated requests. He then ignored the facts and invalidated the historic Opportunity to Ballot (OTB) petitions.

“When we sent our OTB petitions to the Board of Elections on July 22, I said that democracy works. I said it again when the Conservative Party chose to go to court to deny the rights of their membership to have a fair say. In light of today’s biased ruling to deny those rights, I am declaring our intention to appeal this ruling,” said Cox.

“As required by law, more than five percent of the enrolled Conservatives in the First Congressional District signed vowing to defend democracy and the rights of those hundreds of Conservatives who, with courage and conviction, signed the OTB petitions and sent a message to the party bosses,” declared Cox. “They want the right to choose their candidate, to choose a true conservative to defeat Timothy Bishop.”

The successful OTB petition initiative achieved what no Suffolk political observer can recall having been done before - Cox forced an open Conservative Primary over the no-holds-barred opposition of the Party’s leaders and its millionaire designee. Now, with the help of judicial ally, the Conservative leaders have spit in the face of their own membership and real grass-roots conservative voters from the Suffolk County 9-12 Project and the Conservative Society for Action, two of the area’s largest Tea Party groups.

“In an August 15 press release, Suffolk Conservative Chairman Edward Walsh denounced the good men and women of the Suffolk County PBA (Patrolmen’s Benevolent Association) who tried to enroll in his party by saying: ‘This isn’t the first time and won’t be the last that America’s citizens have come under the attack of organized intimidation to try to prevent political freedom.’ Unfortunately, his words can be applied more accurately to the intimidation and invective he has hurled at our grass-roots effort, added Cox.

COURT DENIES COX OPPORTUNITY TO BALLOT

Randy Altschuler, the conservative Republican candidate for Congress (NY-1) and the Suffolk County Conservative Party won a major victory Friday as the State Supreme Court, Suffolk County, released three decisions this afternoon denying Christopher N. Cox his attempt to seek an Opportunity to Ballot on the Conservative Party line. The decisions, handed down by Justice Thomas F. Whelan, block Cox from attempting to challenge, through a write-in procedure, the nomination of St. James businessman, Randy Altschuler as the Conservative Party candidate in the hotly contested battle for the 1st Congressional seat.

The first decision denied Cox the recusal motion, the second decision removes Cox from the ballot and the third denies his petition to validate the Opportunity to Ballot.

Randy Altschuler said, “This is a major victory for the voters of Suffolk County and a major defeat for the candidacy of Christopher Cox. In May, the Executive Committee of the Suffolk County Conservative Party voted 81-2 to deny Chris Cox their party’s nomination. Today, the Supreme Court denied Chris Cox’s cynical and un-democratic attempt to do an end run around the Executive Committee and ultimately the will of rank and file members of the Conservative Party throughout the 1st Congressional District.

“The victory we achieved today brings us a step closer to winning the GOP Primary and uniting the Republican and Conservative Parties so we can defeat Tim Bishop in November.”

Attorney Vincent J. Messina, Jr., who represented the Conservative Party in the case said, “We are thankful that the Court protected the voting public from the ‘statutory irregularities involved in the signature gathering process’ that occurred in this case. We believe that such actions should never be perpetrated upon the voters of Suffolk County, nor bear the imprimatur of any court.”
